Acceptance of Terms
By downloading, installing, or using the Jerry mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, please do not use the App.
These Terms apply to all users worldwide. EU users retain all rights granted under applicable EU consumer protection and data protection law.
Description of Service
Jerry is a mobile platform for the coordination of artists and performers ("Performers") and show producers ("Producers"). The App enables:
- Producers to create and manage shows, including venue details, timing, and Spots
- Performers to discover shows, request Spots, and manage their availability
- Both parties to communicate via show-specific chats
- Real-time coordination during live shows
We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable prior notice.
Eligibility
You must be at least 16 years of age to use Jerry. Users under 18 must have obtained parental or guardian consent prior to use.
Account Registration
To access the full functionality of the App, you must create an account. You agree to:
- Provide accurate, complete, and up-to-date registration information
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorized use of your account
- Be responsible for all activities that occur under your account
User Roles & Responsibilities
5.1 Producers
As a Producer, you are responsible for the accuracy and legality of all show information you publish. You agree to:
- Only publish shows for which you have the necessary rights and permissions
- Use gender/FLINTA restrictions on Spots solely to create inclusive or protected performance spaces, not for discriminatory purposes
- Use the experience level system fairly and in good faith
- Not publish false, misleading, or harmful show information
5.2 Performers
As a Performer, you agree to:
- Only submit Spot requests for shows you genuinely intend to attend
- Honour confirmed bookings to the best of your ability
- Keep your availability calendar up to date
- Use the App's chat features respectfully and in accordance with these Terms
Experience Level System
Producers may optionally assign experience levels to Performers. This feature is subject to the following rules:
- Levels are defined and applied entirely at the Producer's discretion, using a custom scale of their choosing
- Levels are subjective assessments and may differ between Producers for the same Performer
- Producers may change or remove a level assignment at any time
- Levels may only be used to filter show and Spot visibility – not to harass, defame, or discriminate
- Performers can view all experience level ratings assigned to them within the App
Show Visibility & Participant Privacy
- The status of a show (upcoming, live, ended) is visible to all users
- The list of participants is not publicly visible – accessible only to the Producer and confirmed participants
- Once a show ends, it is archived and no longer visible to non-participants
- During a live show, the Producer may send real-time updates to all participants
Chat & Communication
Each show has a dedicated chat accessible only to confirmed participants. The following rules apply:
- Chat messages must not contain unlawful, offensive, harassing, or harmful content
- Archived chats remain accessible to participants for 24 months after the show's end date, then permanently deleted
- Users must not share other users' personal data beyond what is necessary for show coordination
- Jerry reserves the right to review chat content to investigate reported violations
Acceptable Use
You must not:
- Use the App in violation of any applicable law or regulation
- Post false, misleading, or fraudulent show or profile information
- Harass, threaten, or abuse other users
- Attempt to gain unauthorized access to the App or other users' accounts
- Upload or transmit malicious code or spam
- Reverse engineer or decompile any part of the App
- Scrape or systematically collect data from the App
Intellectual Property
All intellectual property rights in the App are owned by or licensed to the Jerry team. Content you create within the App remains your own. By submitting content, you grant Jerry a non-exclusive, royalty-free licence to store, display, and transmit that content within the App for the purpose of providing the service.
Privacy
Your use of the App is governed by our Privacy Policy, incorporated into these Terms by reference. Please review it carefully.
Third-Party Services
The App may integrate with third-party services. We are not responsible for their content or practices. Your use of such services is subject to their respective terms and policies.
Disclaimers
The App is provided "as is" and "as available" without warranty of any kind. Jerry does not verify the accuracy of show information published by Producers, nor guarantee that bookings will be honoured. Jerry is a coordination platform and is not a party to any agreement between Performers and Producers.
Limitation of Liability
To the maximum extent permitted by applicable law, Jerry shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App, including losses from cancelled shows, missed bookings, or reliance on experience level ratings.
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law. EU consumer rights remain unaffected.
Termination
You may delete your account at any time via App settings. We may suspend or terminate your access immediately if you breach these Terms or engage in conduct harmful to other users.
Governing Law & Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Germany. EU consumers retain the right to benefit from mandatory consumer protection provisions of their country of residence.
We encourage users to contact us first at legal@jerry-app.com to resolve disputes amicably. EU users may also use the European Commission's Online Dispute Resolution platform: ec.europa.eu/consumers/odr
Changes to These Terms
When material changes are made, we will notify you via the App or by email at least 14 days before the changes take effect. Continued use after the effective date constitutes acceptance.
